Welcome to www.sakthisuperhub.com (“Platform”, “Website”, “we”, “our”, or “us”).
This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and applicable provisions of Indian law relating to electronic records and e-commerce.
By accessing, browsing, or using this Platform, you agree to comply with and be bound by these Conditions of Use & Sale, including our policies referenced herein. If you do not agree, please do not use the Platform.
1. ABOUT THE PLATFORM
Sakthi Super Hub is an online marketplace and social-commerce platform that enables users to discover and purchase FMCG, food, dairy, wellness, household, and community-made products from small-scale manufacturers, rural enterprises, women-led organizations, and social-impact businesses.
Products may include items manufactured or supplied by:
· Soya Sakthi
· Mirakle Life
· VIA Store
· Sakthi Dairy
· Sakthi Thiranalayam and other social enterprises supporting differently-abled women and rural artisans.
The Platform may operate either:
· as a marketplace facilitator/intermediary, or
· as a reseller/distributor for selected products,
depending on the nature of the product listing and applicable commercial arrangement.
2. ELIGIBILITY TO USE
Use of the Platform is available only to persons who can legally enter into binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Act, including minors, undischarged insolvents, and persons of unsound mind, are not eligible to use the Platform.
If you are under 18 years of age, you may use the Platform only under supervision of a parent or legal guardian.
3. ACCOUNT REGISTRATION
To access certain services, you may be required to create an account.
You agree to:
· provide accurate and complete information,
· maintain confidentiality of login credentials,
· accept responsibility for all activities under your account.
We reserve the right to suspend or terminate accounts that provide false information, misuse the Platform, or violate applicable laws or policies.
4. ELECTRONIC COMMUNICATIONS
When you use the Platform or communicate with us electronically via email, WhatsApp, SMS, or other digital means, you consent to receive communications electronically. Such electronic communications satisfy legal requirements that communications be in writing.
5. PRODUCT INFORMATION
We attempt to ensure that product descriptions, images, nutritional information, ingredients, pricing, specifications, availability, expiry details, and packaging information are accurate and updated.
However:
· actual packaging may differ from images,
· handcrafted products may vary slightly,
· colour/texture variations may occur due to natural ingredients,
· availability may change without notice.
Weights and measurements may be approximate for handmade or artisanal products.
6. FOOD, WELLNESS & DAIRY DISCLAIMER
The Platform may list:
· soya products,
· millet-based foods,
· dairy products,
· wellness foods,
· traditional food products,
· household essentials,
· handmade utility products.
Customers are advised to:
· read labels and ingredient lists carefully,
· verify allergen information,
· follow storage instructions,
· consult a medical professional in case of dietary or medical concerns.
We are not liable for:
· allergic reactions,
· misuse of products,
· improper storage after delivery,
· individual health conditions or sensitivities.
Perishable items including ghee, and refrigerated foods must be stored appropriately immediately after delivery.
7. PRICING & AVAILABILITY
All prices displayed on the Platform are in Indian Rupees (INR).
Prices may include or exclude:
· GST,
· delivery charges,
· handling charges,
· packaging charges,
as specified during checkout.
We reserve the right to modify prices, discontinue products, correct pricing errors, or cancel orders resulting from technical inaccuracies.
8. ORDERS & ACCEPTANCE
Placing an order constitutes an offer to purchase products.
Orders shall be considered accepted only upon:
· successful payment authorization, and
· dispatch confirmation from us or the seller partner.
We reserve the right to refuse, limit, or cancel orders in cases including:
· suspected fraud,
· stock unavailability,
· pricing errors,
· bulk/commercial misuse,
· regulatory restrictions,
· delivery limitations.
9. SHIPPING & DELIVERY
Delivery timelines are estimates and may vary based on:
· geographic location,
· weather conditions,
· strikes,
· logistics delays,
· public holidays,
· product type,
· refrigeration requirements.
Customers are responsible for providing accurate delivery information and ensuring product receipt at the time of delivery.
Risk and ownership of products pass to the customer upon delivery.
We shall not be liable for failure or delay caused by events beyond reasonable control including:
· natural disasters,
· floods,
· pandemics,
· government restrictions,
· transportation disruptions,
· strikes,
· power failures,
· cyber incidents.
10. USER CONDUCT
You agree not to:
· violate laws or regulations,
· upload malicious software,
· interfere with Platform security,
· use automated scraping/data extraction tools,
· create fake accounts,
· misuse discounts or coupons,
· post false reviews,
· infringe intellectual property rights.
Unauthorized use may result in legal action and suspension of access.
11. INTELLECTUAL PROPERTY RIGHTS
All content on the Platform including
· logos,
· trademarks,
· text,
· graphics,
· photographs,
· designs,
· videos,
· product content,
· website layout,
is protected under applicable intellectual property laws and belongs to respective owners, brands, licensors, or the Platform.
No content may be copied, reproduced, distributed, or commercially exploited without prior written consent.
12. THIRD-PARTY BRANDS & SOCIAL ENTERPRISES
The Platform does not guarantee uninterrupted production capacity or inventory continuity from partner organizations.
13. PAYMENT TERMS
Payments may be processed through third-party payment gateways and banking partners.
By initiating payment, you authorize us and our payment partners to process transactions.
We are not responsible for:
· payment gateway downtime,
· banking failures,
· transaction delays caused by third parties.
Users agree not to engage in fraudulent chargebacks or payment abuse.
14. DISCLAIMER OF WARRANTIES
The Platform and all products/services are provided on an “as is” and “as available” basis.
To the fullest extent permitted under law, we disclaim:
· implied warranties,
· merchantability warranties,
· fitness for a particular purpose,
· uninterrupted access warranties.
We do not warrant that:
· the Platform will always be error-free,
· servers will remain uninterrupted,
· information will always be fully accurate or current.
15. INDEMNITY
You agree to indemnify and hold harmless Sakthi Super Hub, its affiliates, directors, employees, partners, and sellers against claims, liabilities, damages, penalties, costs, or legal expenses arising from:
· your breach of these Conditions,
· misuse of the Platform,
· violation of laws,
· infringement of third-party rights.
16. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or relating to these Terms shall:
• Be subject to arbitration under the Arbitration and Conciliation Act, 1996 (as amended).
• The arbitration shall be conducted by a sole arbitrator appointed by ABT.
• The seat and venue of arbitration shall be Coimbatore, Tamil Nadu.
• Courts having jurisdiction over Coimbatore, Tamil Nadu shall have exclusive jurisdiction.
17. MODIFICATION OF TERMS
We reserve the right to amend these Conditions at any time without prior notice.
Updated versions shall be posted on the Platform with revised effective dates.
Continued use of the Platform after modifications constitutes acceptance of revised Conditions.
18. TERMINATION
We reserve the right to suspend or terminate access to the Platform without notice for:
· policy violations,
· fraudulent activity,
· unlawful conduct,
· abuse of services,
· non-payment disputes.
